DISTRIBUTORS & INDUSTRY APPLICATIONS

- Distribution licenses - for beer wholesalers, liquor warehouses or transporting liquor to licensees.
- Certificate of Approval licenses - for out-of-state brewers who sell their product in Utah
- Local Industry Representative licenses - for representatives of alcohol manufacturers, suppliers or importers from out of state.
- Manufacturing licenses - for all manufacturers of wine, beer or distilled spirits.
A beer wholesaler license allows for the licensee to:
- Purchase and import beer into Utah
- Store beer in approved warehouses
- Sell and distribute beer directly to licensed beer retailers and holders of single event permits and temporary beer permits
Applications for new licenses must be submitted no later than the 10th of the month in order to be considered on that month's DABS commission agenda. However, more complex applications may take longer to research and may be deferred to another month's commission meeting by the DABS.
Local licensing will also be required. Check with your local business licensing before applying with DABS. Incomplete applications will be rejected or returned and may then be resubmitted when complete. Please follow your application checklist carefully.
The license year runs from January 1 to December 31, and renewals must be submitted by November 30 annually.

The following documents are incorporated in the application form, but are also available for individual download:
Brewers located outside of Utah, and importers or suppliers of beer, heavy beer, and flavored malt beverages must obtain a Certificate of Approval from DABS before selling or delivering beer to a beer wholesaler in Utah or a flavored malt beverage to the department or a military installation. If the brewer located outside of Utah is a small brewer, it must obtain a Certificate of Approval before selling or delivering beer in Utah to a beer wholesaler, a beer retailer or an event permit holder.
The license year runs from January 1 to December 31 and renewals must be submitted by November 30 annually.

There is no bond for the certificate of approval.
Liquor Transport licenses are issued to individuals or entities to allow them to pick up a retail licensee's prepaid liquor order from a state liquor store or package agency and to transport and deliver the liquor directly to the retail licensee.
The Liquor Transport licensee must have a business license, a $10,000 bond, and evidence the licensee carries a commercial auto policy.
Licensees will be required to maintain an annual report that includes:
- The number of deliveries made to each retail licensee
- Each state store or package agency from which the liquor transport licensee picked up liquor
- Any breakage or shrinkage
A liquor transport licensee may not deliver liquor to anyone except a DABS retail licensee.

Liquor warehousing licenses are issued for the warehousing, distribution and transportation of liquor to wholesale and retail customers. Liquor warehouse licensees may transport liquor in full case lots, via sealed conveyances, to DABS, military bases and out-of-state licensed wholesalers or retailers.
Applications for new licenses must be submitted no later than the 10th of the month in order to be considered on that month's DABS commission agenda. However, more complex applications may take longer to research and may be deferred to another month's commission meeting by the DABS.
Local licensing will also be required. Check with your local business licensing before applying with DABS. Incomplete applications will be rejected or returned and may then be resubmitted when complete. Please follow your application checklist carefully.

If necessary, the liquor warehouse license may be relocated without applying for a new license by completing a change of location application. The change of location application is $300.
The commission will consider the following conditions before a change of location can be approved:
- The physical characteristics of the new premises:
- The location of the warehouse
- Proximity to transportation
- Condition and size and security of the licensed premises
- The person's ability to properly use the liquor warehousing license including:
- Types of products other than liquor the person is warehousing
- Brands of liquor the person intends to warehouse
- How the person intends to distribute the liquor
- Any other factor the commission considers necessary

A local industry representative is defined as anyone who is compensated by any means for representing or selling the distilled spirits, wine or heavy beer of a manufacturer, supplier or importer. A manufacturer, supplier, or importer is not required to use a local industry representative to represent its products in Utah. However, Utah residents who are employed as local industry representatives must be licensed by the state.
Representatives may assist DABS in ordering, shipping and delivering merchandise. They may provide new product notification, listing and de-listing information, price quotations, product sales analysis, shelf management and educational seminars, and may, for the purpose of acquiring new listings, solicit orders from the department and submit price lists and samples of their products to the department.
Representatives may not sell or ship liquor, wine, or heavy beer to anyone within the state other than the department and military installations. Representatives may call on licensed retailers, permittees, and package agents, and provide them with informational material concerning the products they carry.

Brewery
A brewery license is required to manufacture, brew, store, transport or export beer and heavy beer. Brewery license holders may:
- Sell heavy beer to DABS, military installations and to out-of-state customers
- Sell beer to licensed wholesalers
Small brewers (less than 60,000 barrels/year) may sell directly to licensed retailers.
Distillery
A distillery license is required to manufacture, store, transport, import or export liquor. Distillery license holders may sell liquor to the department and to out-of-state-customers.
Winery
A winery license is required to manufacture, store, transport, import or export wines. Winery license holders may sell wine at wholesale to the department and to out-of-state-customers.
